These Terms of Service ("Terms") govern your use of CarCareTaker, available at carcaretaker.app (the "App"), and the website kilelegroup.com (together, the "Services"). The Services are provided by Kilele Group LLC, a Georgia limited liability company ("Kilele Group," "we," "us," or "our"). By creating an account, subscribing, or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. What CarCareTaker does
CarCareTaker helps car owners keep track of vehicle maintenance, set reminders, record expenses, and understand check engine light codes and symptoms. When you type in an OBD2 code or describe a problem, the App uses artificial intelligence (AI) to generate an explanation and possible causes.
2. Important: AI information is not professional advice
Explanations, diagnoses, and suggestions in the App are generated by AI and are provided for general information only. They may be incomplete or wrong, and they are not a substitute for an inspection by a qualified, certified mechanic. Specifically:
- Do not rely on the App alone to decide whether a vehicle is safe to drive.
- If your vehicle shows a flashing check engine light, brake or steering problems, overheating, smoke, fuel smells, or any other sign of a safety issue, stop driving when it is safe to do so and contact a professional.
- Any repair or maintenance you perform, or choose not to perform, is your decision and at your own risk.
- Maintenance reminders are a convenience. Always follow your vehicle manufacturer's recommended schedule.
3. Your account
You must be at least 18 years old, or the age of majority where you live, to create an account or purchase a subscription. You are responsible for keeping your login information secure and for all activity under your account. Please give us accurate information and keep it up to date.
4. Subscriptions and billing
- Plans. CarCareTaker Pro is offered as a monthly plan and a yearly plan. The price, billing period, and any applicable taxes are shown at checkout before you pay.
- Automatic renewal. Your subscription renews automatically at the end of each billing period, and your payment method is charged the then-current price, until you cancel.
- Payments. Payments are processed by Stripe, our third-party payment processor. We do not store your full card number.
- Cancellation. You can cancel at any time through your account or by contacting us. Cancellation stops future charges. You keep access until the end of the period you have already paid for.
- Refunds. Refunds are handled under our Refund Policy.
- Price changes. We may change our prices. If a price change affects your existing subscription, we will notify you by email at least 30 days before it takes effect, so you can cancel before you are charged the new price.
- Taxes. Prices may not include sales tax. Applicable taxes are calculated and shown at checkout.
5. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose;
- Attempt to access other users' accounts or data, or interfere with the security or operation of the Services;
- Copy, resell, scrape, or reverse engineer the App, or use automated tools to extract content from it;
- Upload content that is harmful, abusive, or infringes someone else's rights.
6. Your content
You keep ownership of the information you enter, such as vehicle details, maintenance records, and notes ("Your Content"). You give us permission to store and process Your Content as needed to provide and improve the Services, as described in our Privacy Policy.
7. Our property
The App, its design, software, and branding, including the CarCareTaker name, belong to Kilele Group LLC. We give you a personal, non-transferable, revocable right to use the Services for your own non-commercial purposes while you follow these Terms.
8. Changes and availability
We are continually improving the App and may add, change, or remove features. We aim to keep the Services available but do not guarantee they will be uninterrupted or error-free.
9. Ending your use
You may stop using the Services and delete your account at any time. We may suspend or end your access if you violate these Terms or use the Services in a way that could cause harm. If we end your access without cause, we will refund any unused portion of a prepaid subscription.
10. Disclaimer of warranties
To the fullest extent allowed by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
11. Limitation of liability
To the fullest extent allowed by law, Kilele Group LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for vehicle damage, repair costs, or personal injury arising from your reliance on information provided by the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the 12 months before the claim arose. Some states do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to defend and hold harmless Kilele Group LLC from claims arising out of your misuse of the Services or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Georgia, unless the law where you live requires otherwise. Before filing a claim, please contact us first so we can try to resolve it informally.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page with a new effective date, and notify you by email or in the App if the changes are significant. Continuing to use the Services after changes take effect means you accept the updated Terms.
